These Terms of Service (also called Terms of Use, or "Terms") govern your access to the Local Break iPhone application, localbreak.app, and related services (together, the "Service") provided by Local Break LLC ("Local Break," "we," "us," or "our"). When you accept these Terms during signup or another expressly identified acceptance step, you agree to them. The Community Guidelines form part of these Terms. The Privacy Policy explains our information practices; acknowledging it is not a blanket consent to unrelated processing. If you do not agree to the Terms, do not create an account or use the account-based Service.
The Apple Standard Licensed Application End User License Agreement ("Apple Standard EULA") also applies to the license for the iPhone application. These Terms additionally govern your Local Break account, subscription, content, groups, and use of the Service. If a term about the application license conflicts with the Apple Standard EULA, the Apple Standard EULA controls that license.
1. Eligibility
You must be at least 13 years old and legally able to agree to these Terms. If you are under the age of legal majority where you live, a parent or legal guardian must permit your use, supervise you as appropriate, and agree to these Terms on your behalf. You may use the Service only where permitted by applicable law and any age or parental-authorization requirements communicated through the App Store.
The Service is not directed to children under 13. Do not create an account if you are under 13.
The Service is offered to users in the United States. U.S. distribution does not promise forecast coverage outside the supported New Jersey coastline. Do not use the Service in violation of U.S. export controls, sanctions, or other applicable restrictions. A self-declaration of age or parental permission does not replace any legally required age assurance or verified parental authorization.
2. Accounts
Provide accurate account information, maintain one personal account unless we approve otherwise, protect your credentials, and notify us promptly of suspected unauthorized access. You are responsible for activity performed through your account unless applicable law provides otherwise.
You may not impersonate another person, transfer an account without permission, or use an account for unlawful, fraudulent, or abusive activity.
3. The Service
Local Break provides a focused and retained break library, surf forecasts, personalized forecast context, Scout observations, a private Surf Journal, notifications, profile photos, and private shared-break groups. Feature availability may depend on your subscription, location, device, operating-system version, account state, and the availability of third-party data.
Local Break currently focuses on supported New Jersey coastal areas. A displayed break outside a supported area, or a forecast produced during a source outage, may have reduced or no availability.
4. Subscriptions, trials, and offers
App Store purchases
Paid access is offered through Apple's in-app purchase system. Before you confirm a purchase, the Apple purchase screen or Local Break paywall will display the subscription name and period, included benefits, localized price, and any introductory trial or offer terms. Apple processes payment using your Apple Account. Local Break does not collect your full payment-card number.
Automatic renewal
Unless Apple identifies an offer as non-renewing, subscriptions and trials automatically renew at the standard price displayed at purchase until canceled through your Apple Account. A free or discounted trial begins when confirmed and, unless disclosed as non-renewing, converts to the applicable paid subscription when the offer period ends. Apple determines trial and offer eligibility.
Cancel before Apple processes the next renewal to avoid the next charge. Cancellation normally takes effect at the end of the current paid or promotional access period; deleting the app does not cancel a subscription.
Offer Codes and complimentary access
Apple Offer Codes may provide free or discounted access for the duration, eligibility, redemption limit, territory, and renewal behavior disclosed by Apple when the code is redeemed. Codes have no cash value, may not be sold, and may be revoked where obtained or used fraudulently. A non-renewing complimentary offer ends without a charge; a renewing offer continues at the disclosed standard price unless canceled.
Managing access
Where subscriptions are available, use the purchase restoration control for eligible purchases. Manage or cancel a subscription through Apple's subscription management page. Refund requests are administered by Apple under its policies and applicable law; use Apple's refund request process when appropriate. Contact support@localbreak.app if you need help identifying a charge or accessing a purchased feature. Nothing here limits a refund or cancellation right that applicable law gives you.
Deleting your Local Break account does not automatically cancel an Apple subscription. Cancel the subscription separately before or after deletion if you do not want billing to continue.
Group access
Joining a shared break does not transfer another person's subscription or make the group owner responsible for your subscription. Unless the purchase terms expressly state otherwise, each Local Break account must maintain its own trial, paid subscription, or valid complimentary entitlement.
Price or subscription changes
Apple administers App Store billing and its purchase and renewal communications. Local Break remains responsible for its own applicable disclosure, consent, notice, and cancellation obligations. Any price change follows Apple's procedures and applicable law. If we materially change what a subscription includes, we will provide notice where required. You can cancel a future renewal you do not accept, without limiting any rights provided by law.
5. Shared breaks and invitations
A break owner may create a private shared-break group and invite up to five friends. Active members can see the exact saved break, shared forecast, member display names, profile photos, roles, membership information, and unexpired Scout reports that a member deliberately shares. The owner can see each active member's Scout forecast-input count for that break. Unshared Scout answers, Scout notes, Journal entries, account email, subscription details, and other saved breaks are not shown through the group experience.
Invitation links are private bearer credentials. Anyone with a valid link may preview the inviter's display name, break name, current friend count, and expiration. Invitations are normally one-use and expire after seven days. Do not post an invitation publicly or send it to someone you do not intend to invite.
An owner may revoke pending invitations, remove friends, transfer ownership to an eligible active member, or stop sharing after resolving active memberships and invitations. A friend may leave a shared break. When a friend leaves or is removed, the Service creates a private copy that preserves the break configuration, that user's history, and de-identified derived forecast-learning evidence available at departure. It does not copy the roster, another member's notes or media, or future group updates. Ownership must be transferred or sharing stopped before an owner can delete their account.
You may share only locations you are permitted to disclose. Do not use shared breaks to expose another person's private information, facilitate trespass, harass someone, or create a risk of harm. We may restrict or disable invitations or groups used abusively.
6. Scout, Journal, and other user content
You retain ownership of original content you submit. You grant Local Break a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, analyze, and display that content only as reasonably necessary to provide, secure, support, and improve the Service, comply with law, and honor the sharing choices described in these Terms and the Privacy Policy. This license ends when the content and associated account data are deleted, except for de-identified aggregate results and copies we must retain for legal, security, or backup purposes.
Journal entries remain private to the account unless Local Break later introduces a separate sharing feature and you deliberately use it. When Crew reporting is enabled, submitting a Scout check at a shared break also shares its conditions with that crew, including accuracy-study checks. The submission button and form explain this sharing before you submit. Checks at personal breaks, or while Crew reporting is disabled, are not shared with a crew. A shared report shows current group members the reported wave size, surface, consistency, shape, crowd, your display name, and the report time. You may add a photo or short video. Free-text Scout notes are never included. Shared reports disappear at the saved break's local midnight. Attached media is then deleted from active storage, subject to short provider-processing delays. Flagged reports are hidden immediately, and attached media may be retained privately for moderation for up to seven days.
Group members can report shared reports or media and block a member's crew reports. A submitted in-app report hides the reported post pending review. You may also contact moderation@localbreak.app. Local Break reviews reports and may remove content or restrict accounts. Automated video checks supplement this process; they do not guarantee that every violation is detected. See Report content for reporting, urgent removal, and appeal instructions. Reports are not an emergency-response channel.
Do not submit content that is unlawful, threatening, harassing, fraudulent, malicious, infringing, misleading, or designed to expose another person's personal information without permission. You represent that you have the rights needed to submit your content.
Do not upload sexual content, exploitative content involving minors, intimate images shared without consent (including manipulated images), or recordings that violate another person's privacy or applicable recording law. Obtain necessary permissions for images, voices, music, and other third-party material. We do not acquire a right to use your private Journal or crew media in public advertising merely because you upload it. Group members may capture or copy content outside the Service; do not share material you would be unwilling to disclose to them.
7. Acceptable use
Local Break grants you a personal, limited, revocable, non-exclusive, non-transferable right to use the Service for its intended purpose. Except where law expressly permits, you may not:
- reverse engineer, copy, modify, distribute, sell, or sublicense the Service;
- probe, disrupt, overload, scrape, or bypass access controls, rate limits, subscription checks, or security measures;
- automate account creation, invitation redemption, or false observations;
- introduce malware or attempt unauthorized access to an account, group, system, or data;
- misuse an invitation, push token, authentication token, or other credential;
- use the Service or its data to build a competing product without written permission; or
- violate law or another person's rights.
8. Forecasts, ocean safety, and assumption of risk
Local Break provides estimates and interpretations of surf, swell, wind, tide, weather, crowd, and related conditions. Forecasts, user observations, and notifications may be delayed, incomplete, unavailable, or wrong. Local conditions can change quickly and may not be measured by the Service. A confidence label, recommendation, alert, or personalized result is not a guarantee.
Local Break is not an emergency, weather-warning, navigation, rescue, medical, or life-safety service. Always check official weather and marine warnings, beach closures, lifeguards, public authorities, and direct conditions. You are responsible for assessing your ability, choosing suitable equipment, following local rules, surfing with appropriate supervision or companions, and deciding whether it is safe to enter or remain in the water.
Ocean and recreational activities involve inherent risks, including changing weather, currents, waves, marine life, collision, injury, property damage, and death. To the fullest extent permitted by law, you voluntarily assume the risks of decisions and activities undertaken using information from the Service. Never disregard an official warning or direct evidence of unsafe conditions because of Local Break.
9. Third-party services and data
The Service relies on third parties, including Apple, Supabase, Expo, Mux, Cloudflare, Open-Meteo, NOAA sources, and transactional email infrastructure. Third-party availability, accuracy, security, and performance are outside Local Break's control, and their own terms may apply.
Environmental data is transformed and presented by Local Break. Attribution to a source does not mean that source endorses Local Break. Third-party data and external links are provided for convenience and informational use; verify important information with authoritative sources.
10. Notifications
If you enable notifications, Local Break may send Morning Call, Swell watch, and Crew reports alerts. Crew reports cover reports shared by members and new crew members. Each category is optional. Forecasts may change after an alert is sent, and notifications may be delayed, replaced, or omitted by Local Break, a provider, the device, or the operating system.
Swell watches are early planning signals, not promises of surf quality or timing. Local Break notifications are never emergency or safety alerts. You can change notification choices in the app or iPhone Settings.
11. Service changes and availability
We may add, modify, or discontinue features, supported breaks, data sources, and presentation as the Service develops. Auto-renewable subscriptions will continue to provide ongoing access to the service and updates described at purchase, subject to outages, maintenance, and these Terms. We do not guarantee uninterrupted availability, permanent preservation of every feature, or compatibility with every device.
We may suspend or limit part of the Service temporarily for maintenance, security, provider outages, capacity, or legal reasons. Where practical, we will communicate material interruptions and changes.
12. Suspension, termination, and account deletion
You may stop using the Service or delete your account from Account → Delete Account. If you own a shared break, you must first transfer ownership or stop sharing. Deletion removes the authentication account and account-linked personal product data, subject to limited legal, security, transaction, aggregate, and backup retention described in the Privacy Policy.
Account deletion does not cancel an App Store subscription. You may delete immediately even if a subscription remains active, but access associated with the deleted Local Break account may be lost. Cancel separately through Apple if you do not want future billing.
We may limit, suspend, or terminate access when reasonably necessary to protect users or the Service, investigate abuse, comply with law, address nonpayment or an invalid entitlement, or enforce these Terms. Where appropriate and lawful, we will provide notice and an opportunity to address the issue. Suspension for a Terms violation does not require Apple to issue a refund.
13. Local Break intellectual property
Local Break and its licensors retain all rights in the Service, software, branding, design, artwork, forecasts and compiled presentation, documentation, and other materials, excluding user-owned content and third-party data. No rights are granted except those expressly stated in these Terms and the Apple Standard EULA.
If you send suggestions or feedback, you grant Local Break a perpetual, worldwide, royalty-free right to use them without restriction or compensation, provided we do not identify you publicly without permission.
To report suspected copyright infringement, follow Copyright complaints. Identify the work, the material and its location in Local Break, your contact information and authority, and the statements described there. We review sufficiently detailed complaints and restrict repeat infringers in appropriate circumstances. Do not submit a knowingly false report.
14. Disclaimers
To the fullest extent permitted by law, the Service is provided "as is" and "as available," with all faults. Local Break disclaims implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, quiet enjoyment, and uninterrupted availability.
Nothing in these Terms excludes warranties, remedies, or consumer rights that cannot legally be excluded or limited.
15. Limitation of liability
To the fullest extent permitted by law, Local Break and its officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, goodwill, or data; or damages resulting from reliance on forecasts, observations, notifications, or third-party data.
To the fullest extent permitted by law, Local Break's total aggregate liability arising out of or relating to the Service or these Terms will not exceed the greater of (a) the amount you paid for the Service during the 12 months before the event giving rise to the claim or (b) US $100.
These limitations do not apply to fraud, willful misconduct, gross negligence, or any liability that cannot be excluded or limited under applicable law. Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.
16. Indemnity
To the extent permitted by law, you agree to defend and indemnify Local Break against third-party claims, damages, and reasonable costs arising from your unlawful misuse of the Service, violation of another person's rights, or content you submitted without the required rights. This section does not require indemnity for Local Break's own negligence or misconduct and does not limit non-waivable consumer rights.
17. Governing law and disputes
These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Any dispute that is not resolved informally may be brought in a state or federal court with jurisdiction in New Jersey, and each party consents to personal jurisdiction there.
This section does not deprive you of protections or a forum that the law where you live requires. These Terms do not require arbitration and do not waive a right to participate in a class action where that right otherwise exists.
Please contact support@localbreak.app so we can try to resolve a concern informally. This request does not delay a filing deadline, restrict a government complaint, prevent small-claims proceedings, or prevent urgent legal relief.
18. Changes to these Terms
We may update these Terms as the Service, subscriptions, or law changes. We will post the revised Terms, update the effective date, and provide additional notice or request renewed acceptance when required. Changes do not retroactively reduce rights already earned during a paid subscription period. If you do not agree to revised Terms, stop using the Service and cancel future subscription renewal.
19. Apple terms
The iPhone application is licensed, not sold, under the Apple Standard EULA. These Terms are between you and Local Break, not Apple. Local Break, not Apple, is responsible for the Service, maintenance, support, and addressing claims relating to Local Break. Apple has no obligation to provide maintenance or support for the Service.
Apple and its subsidiaries are third-party beneficiaries of the provisions concerning the licensed application and may enforce those provisions after you accept these Terms. Nothing here changes Apple's rights, purchase terms, refund obligations, or other terms that apply to your Apple Account.
20. Miscellaneous
These Terms, the Privacy Policy, the Apple Standard EULA, and any purchase terms shown by Apple form the agreement governing the Service. If one provision is unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver.
You may not assign these Terms without our consent. Local Break may assign them in connection with a merger, financing, reorganization, or sale of the Service, subject to applicable law. We are not liable for delay or failure caused by events beyond our reasonable control.
Sections that by their nature should survive termination (including ownership, disclaimers, liability limits, disputes, and accrued payment obligations) will survive.
